Welcome to The Kennedy Group (the "Website"), owned and operated by The Kennedy Group, USA Performance Enhancement ("Company," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our website, products, and services, including but not limited to our 1:1 Executive Coaching, Results as a Service packages, digital downloads (e.g., CEO Mindset Reset), and workshops (collectively, the "Services").

By purchasing a Service or using this Website, you agree to be bound by these Terms. If you do not agree, you must not access or use our Services.

1. NATURE OF THE RELATIONSHIP (ICF ALIGNMENT)

1.1 Coaching vs. Therapy In alignment with the International Coaching Federation (ICF) Code of Ethics, you acknowledge that our Services involve a partnership focused on developing professional awareness, leadership strategies, and personal growth.

  • Coaching is NOT Therapy: You understand that coaching is distinct from psychotherapy, counseling, and medical treatment. It does not involve the diagnosis or treatment of mental disorders as defined by the American Psychiatric Association.

  • No Medical Advice: The Kennedy Group does not provide medical, mental health, or legal advice. If you are currently under the care of a mental health professional, we recommend you inform them of the nature of this coaching engagement.

1.2 Client Responsibility You acknowledge that you are solely responsible for your physical, mental, and emotional well-being, as well as your decisions, choices, and actions resulting from the coaching interaction. The Company is not liable for any result or non-result of your actions.

2. SERVICES AND PAYMENT

2.1 Digital Products (e.g., Workbooks, Guides)

  • Immediate Access: Upon purchase of digital products (e.g., The CEO Mindset Reset), you will receive immediate access to the content.

  • Refund Policy for Digital Goods: Due to the nature of digital downloads, all sales of digital products are final and non-refundable once the download link has been sent.

2.2 Coaching Packages & Strategy Audits

  • Payment: Payment is required in full prior to the start of the coaching session or package, unless a payment plan has been explicitly agreed upon in writing.

  • Cancellations & Rescheduling: You must provide at least 24 hours' notice to reschedule a 1:1 session. Failure to provide notice may result in the forfeiture of that session without a refund.

  • Refunds for Services: All coaching services are non-refundable.

3. INTELLECTUAL PROPERTY

All content provided by The Kennedy Group, including but not limited to the CEO Mindset Reset workbook, Results as a Service methodologies, website copy, logos, and course materials, is the exclusive property of The Kennedy Group, USA Performance Enhancement.

  • Limited License: You are granted a limited, non-transferable license to use these materials for your personal and business use only.

  • Prohibitions: You may not reproduce, distribute, sell, or teach our proprietary content to third parties without our express written consent.

4. CONFIDENTIALITY

We adhere to the ICF Code of Ethics regarding confidentiality.

  • Our Promise: We will not disclose any information pertaining to the Client without the Client’s written consent, unless required by law.

  • Exceptions: Confidentiality may be breached if the Coach believes there is an imminent risk of danger to the Client or others, or if illegal activity is disclosed that mandates reporting.

  • Digital Communication: While we use secure methods, you acknowledge that email and video conferencing (e.g., Zoom) have inherent security risks, and you accept these risks.

5. NO GUARANTEES OF RESULTS

Our Services are designed to provide you with the tools, strategies, and mindset shifts to achieve your goals. However, we cannot and do not guarantee any specific results, earnings, or business outcomes. Your success depends on your own effort, market conditions, and implementation.

6. LIMITATION OF LIABILITY

To the fullest extent permitted by law, The Kennedy Group shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Services. Our total liability to you for any claim arising out of these Terms shall not exceed the amount you paid to us for the Services in the month preceding the claim.

7. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law principles. Any legal action or proceeding related to this Website or Services shall be brought exclusively in the federal or state courts located in Maricopa County, Arizona.
